Is that lawyer I smell?

What better way to start the morning, than with a lawsuit(VIA FOXnews). Wham-O is suing Paramount over a scene in "Dickie Roberts " that shows David Spade skidding to halt on the generic slip and slide. Let's go straight to the quote:

Wham-O (search) also claims the scene violates the product's safety guidelines, which limit the use of Slip 'N Slide to children between the ages of 5 and 12 weighing less than 110 pounds and under 5 feet tall.

Frivolous? I thought so too, until I read this, further down in the article:

Monday's lawsuit mentions one legal action brought by a Wisconsin adult who became paralyzed after diving onto the slide while intoxicated. The plaintiff in that case was awarded $12.3 million in damages, according to Monday's lawsuit.

The guy gets drunk, and uses an object in a manner which it clearly isn't designed, gets paralyzed, and the company has to pay him 12 million?

This exposes one of the problems with our spiraling 'dumb lawsuit' problem. Bad lawsuits result in even worse lawsuits. You can't really blame Wham-O for being paranoid. They make a summer toy for kids, and end up having to pay 12 million because a drunk guy plowed his head into something.

There ought to be a law that says, if you're legally intoxicated, you can not sue anyone for anything that you do.
