Side Step, Look ahead

The supreme court decision in the Padilla case is disappointing, though not wholly unexpected. Watch the split thought, we’ll be seeing that split a lot, I think.

If the wiretapping case makes it to SCOTUS (and I think it will), they won’t be able to avoid the issue of presidential wartime powers on a technicality.
