NSA Wiretapping

Down, but not out.

As others have noted, Congress is trying to give the power to the president, though it’s unclear if that will actually make it constitutional (though, clearly, has a better shot than just having the President say it’s within his power).

My guess is the Govt won’t appeal this round, waiting for congress, and then making someone sue again.

Update: I was wrong. CNN is reporting the Govt will appeal.

Like you, I'm not sure any legislation Congress passed on the matter (other than an Amendment of course) would be constitutional, but I'd feel at least a little better just for having the pros and cons argued on by a large group of people and then voted on as opposed to one man simply deciding he has that power.
